These Terms of Service ("Terms") govern your access to and use of the Aivastark platform at www.aivastark.com and any related services (collectively, the "Service") provided by Aivastark ("we," "us," "our"). By creating an account or using the Service, you agree to these Terms.
1. Account
You must provide accurate registration information and keep your credentials confidential. You are responsible for all activity under your account.
2. Acceptable use
You agree not to use the Service to:
- Violate any applicable law or regulation.
- Upload, ingest, or generate content that is unlawful, infringing, deceptive, abusive, or harmful.
- Attempt to reverse-engineer, scrape, overload, or interfere with the Service's infrastructure.
- Use the Service to build a competing product or to train models that compete with Aivastark.
3. Customer data and ownership
You retain ownership of all data you upload to the Service. By using the Service, you grant us a limited license to process that data solely to provide the Service to you. We do not use your customer data to train shared foundation models.
4. Subscriptions, billing, and refunds
Paid plans are billed in advance on a monthly or annual basis. Fees are non-refundable except where required by law. You can cancel any time; your subscription remains active through the end of the current billing period.
5. Service availability
We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance windows will be communicated when possible. Enterprise plans include an SLA.
6. Intellectual property
The Service, including all software, design, copy, and trademarks, is owned by Aivastark and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service per these Terms.
7. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
8. Limitation of liability
To the maximum extent permitted by law, Aivastark's total liability arising out of or relating to these Terms or the Service is limited to the amount you paid us in the 12 months prior to the event giving rise to the claim.
9. Termination
We may suspend or terminate your account if you breach these Terms, fail to pay fees, or use the Service in a way that creates risk to Aivastark or other users. You may close your account at any time.
10. Governing law
These Terms are governed by the laws of the jurisdiction in which Aivastark is registered, without regard to its conflict-of-laws provisions.
11. Changes
We may update these Terms; material changes will be notified via email or in-product notice. Continued use after the effective date constitutes acceptance.
